The Labour Code in Brazil (Consolidao des Leis do Trabalho of 1943 or CLT) stipulates that formal sector workers sign a standard work contract that is ratified by the Brazilian Ministry of Labour. A record of these contracts is then kept by the worker in a ‘work card’ (carteira de trabalho). The law further mandates that all workers have this ‘work card’ (which is normally in booklet form) in which individual contracts and changes are registered with the employer. Thus, a worker with a work card signed by the employer is considered a formal worker. If a worker works with a work card unsigned by their current employer they are generally considered to be informal (sem carteira assinada). The data gathered by labour and statistical authorities is used to contextualize formal and informal employment in Brazil (as demonstrated below).
The data in Chart 5.2 indicate the degree of formalization among employed workers. When the data are disaggregated by gender, men’s employment remains stable, whereas there is a notable growth in women’s employment. For men, in the period 1995–2006, there is little variation in formal, and what might be called informal, employment.3 The data suggest an increase during the same period in the percentage of women in both formal employment (going from 22.7 percent to 27.5 percent) and informal employment (10.1 percent to 13.6 percent). The growth in formal employment may reflect the increase in surveillance by the Ministry of Labour of employers and businesses in an effort to curtail informal employment throughout the Brazilian economy.
